STATE AND FEDERAL COMPLIANCE

Healthcare providers are governed by varying sets of Federal and State regulations depending upon how they are structured and what types of services they are providing.  Our licensed attorneys can walk you through the complex web of Federal and State laws to help you determine which laws apply to your entity and counsel you on how to remain in compliance with the applicable regulations.  Whether you have questions about Federal privacy laws (HIPAA, CFR 42 Part 2, etc.), STARK laws, Federal Anti-Kickback or State prohibitions against self-referrals, fee-splitting, kickbacks, patient brokering or certain types of rebates, we will educate you about the laws and what steps must be taken to comply with each.

 

POLICY AND PROCEDURE MANUALS

In order to obtain and maintain licensure and accreditation, your program will be required to have and submit a policy and procedure manual that outlines exactly how your company plans on complying with each applicable regulation or standard.  We will work with you to understand what levels of care you are providing and jointly craft procedures that not only meet minimum standards, but represent best practices in the industry.  Our manuals are organized so that both state agencies and national accreditation agencies can easily identify and locate each policy that applies to their set of standards.     

 

CLINICAL CHART AUDITS

One of the most important aspects for any healthcare provider (for compliance and reimbursement purposes) is the quality of the medical or clinical records and notes that are being prepared by their professional staff.  State administrative agencies, national accreditation agencies and insurance companies all have differing requirements for records and documentation.  Our licensed masters level clinicians and clinical experts will train your staff on proper documentation protocols, conduct independent audits of your records and recommend ways to improve your documentation to support the medical necessity for your services.   



CIVIL LITIGATION

LANDLORD-TENANT

Whether you are the landlord or the tenant of a leased property, your rights and obligations will be defined by Chapter 83 of the Florida Statutes, as well as your lease agreement.  Our attorneys are experienced in representing both commercial and residential landlords and tenants with regard to the disputes that can arise during a tenancy.  Additionally, our team is intimately familiar with the statutory eviction procedures and will be able to ensure that you recover possession of your property as quickly as the law allows (if you are the landlord), or that you are not wrongfully evicted (if you are the tenant). 

 

 

STATE LICENSING

All healthcare providers must obtain a license(s) to provide services from the state in which they are located.  We can help you get licensed and stay licensed.  We will walk you through the application process, assist in gathering necessary documents to complete your license application, submit your application and work closely with the governing administrative agency to ensure that your entity receives its license as quickly as possible.  We also provide ongoing consultation, compliance training and quality assurance services to ensure that your entity remains in compliance with the requisite state regulations.

 

UTILIZATION REVIEW TRAINING

Our Utilization Review team will help you maximize your agency’s potential for reimbursement from private insurance companies by training your staff how to appropriately assess and document clinical necessity for treatment.  Additionally, we will work together with your staff to ensure they maintain a thorough understanding of ASAM criteria for each level of care, understand payor push-back related to objectivity and are prepared to handle peer to peer reviews and physician approvals and denials.

Private healthcare can be an extremely competitive world.  How do you set your apart from other private healthcare providers that provide the same or similar service?  One-way providers set themselves apart is to obtain a nationally recognized accreditation (Joint Commission, CARF, Council on Accreditation, etc.).  We will prepare and submit all documents and applications required for national accreditation (Joint Commission, CARF, Council on Accreditation, etc.), develop a policy and procedure manual for the chosen levels of care you wish to have accredited, train your staff on all aspects of the policies and procedures, conduct pre-audit reviews of your clinical charts and HR files and attend your accreditation audit.

 

TRAINING AND IMPLEMENTATION

Whether we assisted in the preparation of your policy and procedure manual(s) or you drafted them yourself, our experienced administrative team, clinical experts and licensed clinicians will come on-site and conduct trainings for your clinical staff to ensure that they are aware of your company’s polices and understand how to implement and utilize your established procedures.
